Terms of Use
Last updated: October 5, 2026
These Terms of Use govern your use of timberlandcabinets.com (the “Site”), operated by Timberland Cabinetry, a brand of Birch Investment Partners LLC (“Timberland,” “we,” “us,” or “our”).
1. Acceptance of these Terms
By accessing or using this Site, submitting a form, or requesting a quote, color chip, or showroom appointment, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Site.
You must be at least the age of majority in your state of residence to submit information or requests through the Site. If you use the Site on behalf of a company, such as a builder or dealer, you confirm that you are authorized to accept these Terms on its behalf.
2. Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- Submit false, misleading, or another person's information through any form;
- Use bots, scrapers, or other automated means to access, copy, or collect content or data from the Site;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or connected systems;
- Send spam, malware, or unsolicited advertising through the Site or its forms;
- Copy, frame, or republish Site content, including product photos and descriptions, for commercial purposes without our written permission; or
- Use the Site in any way that violates applicable law or the rights of others.
We may update, suspend, or discontinue any part of the Site at any time without notice, and we may restrict or end access for anyone who violates these Terms.
3. Product information, colors, and images
We work to keep product information accurate, but door styles, finishes, specifications, and availability may change without notice, and some combinations may be discontinued or offered only while supplies last.
Finish colors shown on the Site are approximate. Screen settings, lighting, photography, and the natural grain and color of wood all affect how a finish appears, and stained finishes vary from one wood piece to the next. Photos of kitchens, baths, and showrooms are for illustration and may include items, hardware, countertops, or customizations not included in a standard order. Please review a physical color chip or sample before making a final selection.
Natural variation in wood grain, color, and finish is a characteristic of real wood cabinetry and is not a defect.
4. Quotes, pricing, and orders
Information on the Site, including any pricing, is not an offer to sell. Quote requests and design consultations do not create a contract or obligate either party.
Any quote we provide is an estimate based on the information available at the time and may change if measurements, specifications, selections, or material costs change. Orders are binding only when confirmed in a separate written agreement or order signed or accepted by Timberland. If anything in that agreement conflicts with these Terms, the agreement controls for that order.
Design drawings, layouts, and renderings are provided for planning purposes. Final specifications are those confirmed in your written order.
5. Color chips and samples
Color chip and sample availability, quantities, and any associated charges are as described on the Site or by our team at the time of your request and may change. We may limit the number of color chips or samples provided per customer or project.
6. Product warranties
Product warranties, if any, are provided only under our written warranty terms and the terms of your order. These Terms of Use do not create any warranty for our products.
7. Your submissions and communications
When you submit a form, you agree that the information you provide is accurate and that we may contact you by phone or email about your request. Message and data rates may apply to any communications you receive on a mobile device.
If you send us photos, measurements, ideas, or feedback, you grant us a non-exclusive, royalty-free license to use them to respond to your request and to operate and improve our products and services. We will not publish photos of your home or your name without your permission.
8. Builders, dealers, and trade accounts
Submitting a dealer application does not create a dealer, agency, or business relationship. Dealer and trade accounts, wholesale pricing, and the dealer portal are governed by separate agreements and terms. Any wholesale pricing or account information we share with you is confidential and may not be shared publicly.
9. Ownership of content
All content on the Site, including text, photos, product images, videos, graphics, logos, and the design and arrangement of the Site, is owned by Birch Investment Partners LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may view and print Site content for your personal, non-commercial use in planning a project. Any other use, including copying, modifying, distributing, or creating derivative works, requires our prior written permission. Names, logos, and marks displayed on the Site belong to us or their respective owners, and nothing on the Site grants you a license to use them.
10. Third-party links and services
The Site may link to or include features from third parties, such as maps, social media, or the dealer portal. We are not responsible for the content, availability, or practices of third-party websites or services, and your use of them is subject to their terms and privacy policies.
11. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
This section applies to your use of the Site. Warranties for products you purchase are governed by our written warranty terms and your order.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BIRCH INVESTMENT PARTNERS LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Birch Investment Partners LLC and its owners, employees, and agents from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in or serving Maury County, Tennessee, and you consent to the jurisdiction of those courts.
15. Privacy
Your use of the Site is subject to our Privacy Policy, which explains how we collect and use information you submit.
16. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above shows when they last changed. Continued use of the Site after changes are posted means you accept the updated Terms.
17. General
If any part of these Terms is found unenforceable, the remaining parts stay in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding use of the Site and replace any prior terms for the Site.
